Restaurant Terms of Service
Last updated: October 31, 2026
These terms (version 2026-10-31) govern your restaurant's use of OvenGo: the ordering website, point of sale, kitchen display, loyalty, messaging and dashboard we provide. By creating an account or using the service you agree to them.
1. The service
OvenGo provides software that lets you take orders directly from your guests, run a kitchen display and point of sale, message guests about their orders, and manage menus, staff and reports. We host the service and may update it at any time. You are responsible for your menu, prices, taxes, hours, food safety, fulfilment and compliance with local law.
2. Accounts and staff
You are responsible for everyone who uses your account, including staff PINs and manager approvals. Keep credentials confidential and tell us promptly about unauthorized use. You confirm that staff whose hours are tracked on the till have been informed of that tracking as required by law.
3. Fees and billing
Plans and prices are shown on the pricing page and in your dashboard. The Flex plan carries a monthly fee plus a percentage platform fee on online orders; the Flat plan carries a monthly fee and no per-order platform fee. Fees are billed monthly in advance through our payment provider, are exclusive of taxes, and are non-refundable except as required by law. Card-processing fees charged by your payment processor are separate. We may change prices with 30 days' notice.
4. Payments and payouts
Online payments are processed by third-party processors (for example Stripe) under their own terms. You authorize us to initiate refunds you or your staff approve. You are the merchant of record for your orders and responsible for chargebacks, refunds and sales tax.
5. Guest messaging
We send order-status messages to your guests on your behalf. Marketing texts go only to guests who have consented through the platform, follow the SMS Terms, honor STOP requests and quiet hours, and may be paused if carriers or we see abuse. You are responsible for the content of messages and promotions you write.
6. Your data and your guests' data
You own your menu, order history and guest list. We process guest data as your service provider to run the service, as described in the Privacy Policy. You may export your data from the dashboard at any time. We keep backups and may retain records after cancellation as described in the Privacy Policy.
7. Acceptable use
Do not use the service for unlawful content or sales, to spam, to infringe others' rights, to probe or disrupt our systems, or to misrepresent who you are. We may suspend accounts that put guests, other restaurants or the platform at risk.
8. Term and termination
Plans renew monthly until you cancel from the dashboard. Either party may terminate for material breach. On termination your ordering site goes offline; you may export your data for 30 days afterwards.
9. Warranties and liability
The service is provided "as is". To the fullest extent permitted by law, we disclaim implied warranties and are not liable for indirect or consequential damages, lost profits or lost data. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.
10. Indemnity
You will defend and indemnify us against claims arising from your menu, food, pricing, taxes, marketing content, or your breach of these terms or the law.
11. Governing law and disputes
These terms are governed by the laws of the State of New York. Disputes will be resolved in the state or federal courts located in New York County, except that either party may seek injunctive relief anywhere.
12. Changes and contact
We may update these terms; material changes are announced in the dashboard at least 30 days in advance and the version number changes. Questions: support@ovensmith.com.
